Terms of Use

By accessing or using MortgageCheck, you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you may not access the service.

These terms apply to all users, including brokers, agents, and any borrowers who interact with broker microsites.

MortgageCheck provides AI-powered pre-qualification tools for Canadian mortgage professionals. The service includes branded microsites, lead capture, automated notifications, and educational estimates.

Important: MortgageCheck provides educational estimates only. We are not a lender and do not make lending decisions. All estimates are subject to full underwriting by licensed lenders.

Monthly Plans: Subscriptions renew automatically each month until cancelled.

Price Changes: We may adjust pricing with 30 days' notice. Existing subscriptions continue at their current rate until the next renewal.

Cancellation: Cancel anytime at mortgage-check.ca/cancel. Your access continues until the end of the current billing period.

Refunds: We offer a 14-day money-back guarantee for new subscribers. After that, refunds are not provided for partial months.

Accurate Information: You must provide accurate brokerage and licensing information.

Regulatory Compliance: You are responsible for complying with all applicable mortgage broker regulations, advertising rules, and privacy laws in your jurisdiction.

Client Communication: You must clearly communicate that MortgageCheck estimates are educational and not lending commitments.

Content Ownership: You are responsible for all content you add to your microsite (bio, photos, custom messaging).

You may not use MortgageCheck to:

• Collect or store Social Insurance Numbers (SINs)

• Make false or misleading claims about lending approval

• Spam or harass borrowers

• Resell or redistribute access to the platform

• Attempt to reverse-engineer or scrape the service

• Violate any applicable laws or regulations

Our IP: MortgageCheck, its logo, and the platform technology are owned by MortgageCheck Inc. You receive a limited, non-transferable license to use the service while your subscription is active.

Your Content: You retain ownership of content you provide (photos, bios, etc.). By uploading, you grant us a license to display it on your microsite.

We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice.

We reserve the right to modify, suspend, or discontinue features with notice. We will provide at least 30 days' notice before discontinuing core functionality.

MortgageCheck is provided "as is" without warranties of any kind. We are not liable for:

• Lost revenue or business opportunities

• Decisions made based on pre-qualification estimates

• Third-party actions or lender decisions

• Service interruptions or data loss

Our total liability is limited to the amount you paid us in the 12 months preceding any claim.

We may suspend or terminate your account if you violate these terms, fail to pay, or engage in fraudulent activity.

Upon termination, your microsite will be deactivated. You may request export of your lead data within 30 days.

These terms are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved in the courts of Ontario.

We may update these terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use after changes constitutes acceptance.
